Am I allowed to use/repost/sell your art?


You're free to use my art as profile pictures and banners on various personal social media sites. In those cases I don't actually care all too much about crediting, it would be highly appreciated tho.You can also simply use my art as desktop wallpapers and such. In those cases: please let me know about that, I actually take that as a pretty big compliment!        :)When it comes to remixing, editing, or simply using my art as background for your own content (For example background for a Youtube music upload), I don't mind that as long as you show the same amount of leniency (i.e. don't remix/edit my art if you don't want your own content to be subject to remixing and/or editing), but please give appropriate credit by linking to this website.When it comes to reposts of my art, I have a very hands-off approach. Generally I'm fine with having my art shared around and/or reposted on imageboards like Danbooru, hell, I even feel flattered, as long as it's not monetized art like my patreon rewards. Crediting would be kind however. Ideally with a link to this website.        :)However, do not sell my art or put it behind paywalls without my consent.


Can I draw your OCs?


Absolutely! That would make me extremely happy even!

However, just a heads-up, I'm not a big fan of hardcore NSFW content of my characters. In those cases you probably won't get a response from me, but I still prefer this far more over you deciding not to draw them in the first place. I'd still be incredibly thankful that my characters interest you enough for you to spend your time and skill on them!I also strongly believe in artistic freedom. You can change my character's design and alter things as you like. For me it's really interesting to see different approaches to a character, whether it's a genderswap, colorswap, raceswap, sizeswap, ageswap; I think they're all interesting to see if done with respect.


Can I trace your art?


I don't mind it. Despite popular opinion, I do believe tracing is a valid form of learning muscle memory and basic deconstruction. But just like with everything else, don't let it become your crutch and please link to the original work if you decide to post it on social media.Also be wary of people calling you a copy-cat. As long as you're honest about the art being traced and respect the wishes of the original artist, I believe it's fine.


What is your opinion on AI art?


First of all, I have to clarify that, as an artist making money out of my work, I have a huge biased against AI generated art.
I'd also like to ask you to not use any of my drawings or other pieces of my content for AI training or inclusion in a dataset.
The technology on its own, I think, can be a useful tool to get quick inspiration kicks or to get generic textures like "Wood" or "Marble". However, the fact that most AI generators use copyrighted material in its dataset makes it unethical in my view. If a dataset is based on one's owned images, consenting artists, public domain, and/or CC0 images, then I don't really see a problem with it.I personally do consider AI art to be "real art". I do understand the worries that this might devalue the meaning of "art", but honestly, with art pieces like a banana taped to a wall, or urine on copper plates, or literally an all-white painting, I don't see how AI would tarnish the meaning of "art" any further that those examples did. The entire industry is sadly known to just be money laundering anyway.However, I strongly dislike the idea that someone who uses AI generation is somehow an "artist", as their role is much more in-line with an art director or commissioner.
The fact AIbros love to show their narcissism by vilifying artists, yet are offended by not being considered artists themselves is simply funny to me.
Also, I don't like seeing AI art since the value of an artwork, for me, lies in the effort, skill and passion put behind it. If you ever see me give a like to an AI generated image, be aware that it happened on accident.
It does make me quite angry, if the fact that something is AI generated is actively being concealed. At least be open about it.

Can I copy your style?


Yeah sure, go ahead.       :)
There rightfully isn't a copyright for this anyway.
If it helps, I usually upload timelapses of my art on Twitter and Mastodon. You can also find downloads to several layered .psd files on the gallery tab or in my archive.I truly hope that analyzing those can help you. I'm much better at doing art, than explaining it. I'm outright terrible at it, so I'm really sorry that I can't make tutorials or teardown videos for the time being.


What inspires you?


People are inspired by a lot of things. Their surrounding, life experience, conversations, history, consuming other artists' work... A lot of those things are taken in unconsciously, so giving a concrete answer is pretty hard.If I had to name specific thing, just strolling around town or listening to certain genres of music inspire me the most. Browsing through fashion magazines is also a great source of quick inspirational kicks.


What tools do you use?


For digital art, I use Clip Studio Paint EX for drawing and the Affinity Suite for design stuff. Hardware-wise I use a Huion Kamvas Pro 20 pen display. Another tool that helps me a lot is a Razer Tatarus keypad for keybindings... If only Razer's software wouldn't suck so much.For traditional, I prefer to draw with pencils, usually a 4B, 8B and sometimes a HB for detailed drawings.
Most artists usually have a relatively small hardness/softness range they prefer, so I don't recommend getting a set with a full range of pencils from 6H to 10B, as you're most likely not gonna use half of them; I know I didn't.


How long does one artwork take to make?


It depends heavily on the complexity of a specific artwork and on how motivated I am.
A simple colored sketch can be done in an afternoon, while detailed artworks with background and multiple characters can take several days, sometimes even weeks.


Someone is stealing your art.


First of all, I wholeheartedly thank you for your help, I appreciate every single warning about potential art theft that's brought to my attention.Before contacting me about this, if possible, please let the person know that stealing someones art is wrong or that they should at least give proper credit. Please be polite and nice about it, there's a good chance that the person is simply unaware of these manners.
If talking doesn't work, then it should probably be reported to the site.
However, if someone is selling my art or claiming it as their own, please send me a link to it so I can try to get it down.

Send me those information through one of the given contact ways:

  • Type of commission: Lineart/Colored/Detailed.

  • Character View: Head shot/Half body/Full body.

  • Number of Characters: 1/2/3...

  • Will the commission be used commercially: Yes/No.

  • If yes: How will the commission be used: Social media banner, Game asset, Poster, T-shirt design, etc.

  • Character personality traits: Happy, Cheerful, Boyish, Smug, Drunk, etc.
    (Keep it short please)

  • Reference of the character: Send me clear image references of the character.
    (See "Character Design" if no reference exists.)

For Character Design


If you want me to design a character, you must add those information as well:

  • Color pattern: Red and Blue, Different shades of green, low contrast, high saturation, Purple eyes, etc.

  • Style: Gothic, Futuristic, Cyberpunk, Steampunk, etc.

  • Image references: Send me images of clothes, objects, animals or general moodboards that you imagine for, or remind you of the character.

  • Special traits: Cat ears, Demon wings, Mole on cheek that looks like Greenland, etc.
    (Optional)

Please replace the italicized examples with your own details.


After you have send me your order information:

  • I accept or decline your order.

  • I draw a rough sketch.

  • You approve the sketch or ask for a revision.
    (I'll do unlimited revisions in this phase.)

  • I request at least 50% of the price up-front.
    (This is solely for security reasons.)

  • Once I receive the payment, I add you to the waiting list.

  • You'll be notified once I start working on your order. This will take at least several days.
    (Refunds are not possible after receiving the notification.)

  • Afterwards I will send you several WIPs (Work In Progresses) throughout the progress to update you and make small revisions if requested.

  • I notify you once the commission is done. If you have no further wishes for any small changes, I will request the rest of the payment.

  • Once the payment is received, I will send you a Google Drive link with all the files contained in an archived .zip folder.

  • You will receive two high quality .png files (One watermarked, one unwatermarked), a .psd file and a full timelapse video as an .mp4 file.

Notes

  • If you have any questions or comments, please feel free to reach out to me.

  • Ordering a commission from Synoh means that you have read, understand, and accept his terms of service.

  • The waiting time for a commission can reach from a few days to several months. It heavily depends on the amount of orders currently in process and the complexity of your commission.

  • Prices are only negotiable on large projects.

  • Prices may change at any time without warning, customers already on schedule at that time will only be affected by price reductions and discounts.

  • Usually the artworks are done with 3.840 pixels on the long side and with a pixel density of 300 dpi. However feel free to consult me about specific sizes that you may want.

  • I don't work with Photoshop when doing digital 2D character art. While I try to accommodate typical compatibility issues, the artwork seen in the .psd file may still look slightly different from the artwork seen in the .png file.

  • The original .clip file is also available if requested.

  • Despite a watermarked version of the artwork always being part of the overall package, you are not required to ever actually use it instead of the unwatermarked version.

  • While I say that I'll do unlimited revision in the sketching phase, if I notice that the revision requests are done in bad faith I'll refuse further work on the commission.

  • Sketches and WIPs will never be presented in original quality.
    (This is simply a security measurement. I'm sorry if this seems inconvenient, but I sadly believe this to be necessary.)

  • All personal identifiable information, contained in any material published for promotional purposes, will be censored.

  • I keep the right to cancel a commission at any time for any reason. Any payment that has been made at this point will be fully refunded.

  • An improvement in my skills, from when you got your first commission, is not a valid reason to get a refund/free commission.

  • I will keep backups of any commissions. If for whatever reason you lost your files, I will gladly resend them.
    (This is however not a 100% guarantee, as there is always a chance for backups to be corrupted.)

  • If your preferred payment method is in exposure, I request at least three references in which you have promoted work in the past, as well as a market analysis of your followers.
    (The decision, whether or not the potential exposure is worth it, is mine to make, not yours.)


Terms of Service




Please read the terms of service (the “Terms”) carefully. They govern the use and access of the service, and any first-party goods provided to you (the “Commissioner”, “Client”, or “Costumer”) by Synoh, including images, graphics or other material (the, “Goods”, “Artwork” or “Commission”). Synoh is also referred to in these Terms as “I”, “me”, and “artist”.Contacting me for a commission means that you have read, understand, and agree with these terms of service. Provided Service


  • The artist shall provide you, upon your agreement with the terms and conditions, with the service and goods. During the service, I will provide you with regular updates of your commission. Upon full payment, I will provide you with necessary access to the finished commission.

  • The rights to the artwork as is shall not be part of the transaction and shall stay exclusively with the artist. The story, setting, characters, design, ideas, and concept that may be portrayed in the artwork belong to their respective rights holders.

  • Depending on the complexity of the commission, the completion time may range from a few days to several months.

  • The service is officially fulfilled after your confirmation, that you have received the files complete and in good condition.

  • None of the following shall constitute a breach of the terms.

  • In no event shall the artist be responsible or liable for any failure or delay in the performance of their obligations hereunder arising out of or caused by, whether directly or indirectly, forces beyond its control, including, but not limited to, accidents, acts of war or terrorism, civil or military disturbances, nuclear or natural catastrophes or acts of God, and interruptions, loss or malfunctions of utilities, communications or computer (software and/or hardware) services;

  • Technical fault or network communication errors;

  • Faults of your computer system or networks;

  • Inability for you to use normal computing systems.

  • You are free to share or give your commission to third-party individuals and entities as long as they agree with these terms.


Personal use


  • When requesting a commission for personal use, you agree that you shall not use your commission for any financial benefits, whether directly or indirectly.

  • You are free, however, to use the artwork for any non-monetary purposes, including, but not limited to, printing, gifting, personal social media assets, etc.

  • You are not obligated to give credit to the artist when publicizing the personal use commission.

  • You are, however, required to answer truthfully that the artwork is a commission when asked about it and you shall not give indication that you are the creator of the artwork as is, or otherwise mislead third-parties from the true origin of the artwork.


Commercial use


  • Once agreed upon, the artwork can be used for commercial purposes by the commissioner, in accordance with the respective tier, as stated in the commission info.

  • When using your commercial use commission as a social media asset, you are required to give proper credit to the artist by stating “Art by Synoh” or a statement of similar nature.

  • You are required to purchase either “Tier 2” or “Tier 3” in order to sell products and merchandise featuring the artwork.

  • You may change a personal use commission to a commercial use commission at any time after the goods have originally been delivered. You will be charged the noted commercial use prices as stated in the commission info according to the new intended purpose of the commission. This process is not possible vise-versa.


Promotional use


  • Unless otherwise negotiated with the customer, the artist shall have the right to use the artwork, as well as all sketches, work-in-progresses, and otherwise consequential, and/or derivative material of it for promotional purposes. This may include, but is not limited to, social media posts, and portfolio entries.

  • You may pay a 20% “no post” fee of the final price, to have your commission not be used for any and all promotional purposes by the artist.

  • Any publication for promotional purposes by the artist shall be watermarked, declared as a commission, and shall only be published in a considerably poorer quality and resolution than the version delivered to the customer.

  • Unless otherwise declared by the customer, the artist shall censor any and all personal identifiable information relating to the commissioner portrait in any material.


Product


  • It is your duty to check the goods’ completion, integrity and condition, immediately upon receipt.

  • I am not liable for any lost or damaged files after the goods have been delivered and their completion, integrity, and condition has been positively confirmed by the customer.

  • While it is not a guaranteed service, you may ask for a resend of the goods and I may deliver them at no extra charge.

  • Unless otherwise specified by the customer, the goods consist of two .png files, one .psd file, and one timelapse video with the drawing process as a .mp4 file. The two .png files consist of one watermarked and one unwatermarked version respectively.

  • All goods are digital in nature. No shipping will be done.

  • Unless otherwise specified by the customer, the artwork will be done in 3840 pixels on the long side and with a pixel density of 300 dpi. The artwork will be either horizontally, vertically or squarely orientated, depending on composition.

  • Extra charges may apply, if the artwork is larger than 10.000 pixels on any side.

  • The naming scheme of the goods may contain your name, they can not be anonymized but will only be visible to you, the artist, the file hosting provider, and any third-party individuals and entities you share the files with.

  • “Your name” may be replaced by a company name, trademark, your online pseudonym, or your alias.


Watermark


  • You agree to not tamper with the watermark in any way, including but not limited to, erasing, blurring, resizing, changing colors, etc.

  • You are not required to use the watermarked version of personal use commissions. Any use case of the watermarked version is entirely optional and may be replaced by the unwatermarked version, as seen fit by the commissioner.


Payment


  • You agree to pay the artist for the goods and services provided within this agreement.

  • The price for goods and services is based on stated value according to the commission info. All prices are referenced in US dollars.

  • You must pay through an authorised payment processor. You must agree to any terms and conditions provided by them in order for the artist to receive payment. All payments must be sent in US dollars. The authorised payment processor includes Paypal, through Ko-fi or directly.

  • If you fail to pay the artist within a reasonable timeframe then I have the sole right to cancel your access to the goods and services without any recompense to any potential damages.

  • Upon delivering notification to you, that work on your commission has begun, any request for refunds shall be declined.

  • The artist shall provide you with a reasonable amount of time to cancel the commission and request a refund, if such a request is not made within the timeframe it will be considered as confirmation that you agree to pay the rest of the declared price once the commission is done and ready for download.

  • Prices may change at any time with or without cause, with or without notice, effective immediately. Potential customers that contacted me prior to price changes shall exclusively be affected positively by these.

  • Price decreases and discounts shall take effect one week prior to their official announcement.


Waiting list


  • You agree that you may be put on a publicly available waiting list.

  • The waiting list will be available and will be regularly updated, as long as the relevant third-party services are available and functional as intended.

  • You may ask for your slot to be anonymized, otherwise the slot will be marked with your company name, your online pseudonym, your alias, or your name, in that order as available or by preference. It is not possible, however, to fully delete or hide your slot on the waiting list.


Cancellation


  • Cancellation by you. If you wish to cancel this agreement you may do so by notifying the artist of your decision. If the cancellation happened before you have received notification that work has begun, you shall receive a full refund of any payment made at that point.

  • Cancellation by me. I keep the right to cancel your access to my services with or without any cause. The effect of this cancellation shall happen after notifying you of this decision and providing you a full refund of any payment made at that point.


Confidentiality


  • The artist and commissioner shall not disclose any of the other's personal identifiable information to any third-parties without the explicit consent of the other party.


Changes to the Terms of Service


  • I may revise any terms in this agreement at any time with or without any cause, with or without notice, effective immediately.

  • Any changes to the terms shall not be enforced retroactively.
